Terms of Service — War of Fantasia

In force. The operator, the governing law and the contact address are
filled in (D256), so pnpm legal:check passes and the server will start
with a live Stripe key. See docs/LEGAL-CHECKLIST.md.

Stripe is the seller of record for anything you pay for here, through
Managed Payments (D253): it collects the money, works out and remits the
tax, sends the receipt and handles disputes. Section 5 says so in detail.

This document follows standard industry patterns and the statutory
requirements that apply to a small digital game. It has not been reviewed
by a lawyer. It is written to be defensible and honest rather than
maximally aggressive, on the view that a term a court will strike out is
worth less than a term that holds.
1. Who this is
War of Fantasia ("the Game") is operated by Erik Perez ("we", "us"). You can
reach a person at erikdanielperez@nexuscoregaming.com.
2. Playing
The Game is free to play. You may play it, talk about it, stream it, record it,
and make art and videos about it, including for money, provided you do not
claim to be us or to be endorsed by us.
You need an account to keep a record, use the leaderboards or play other
people. You sign in with an email address or a Discord account; there is no
password. Keep access to whichever you used — anyone who can read your mail or
open your Discord can sign in as you.
3. Chat, names and anything else you type
The Game lets you type: a player name, and messages during a live match.
Whatever you type is yours, and you are responsible for it.
You agree not to send, or choose as a name, anything that:
- harasses, threatens, bullies or incites violence against anyone
- is hateful towards people for who they are
- sexualises a child in any way
- is somebody else's personal information
- is spam, advertising, or a link intended to deceive
- impersonates another player, us, or anyone else
How we moderate. We are one person, we do not read every message, and we
are not obliged to. We do act on reports. Write to erikdanielperez@nexuscoregaming.com with what
happened and roughly when, and we will look. We may remove a name, mute an
account, or close it. Serious matters — credible threats, or anything
involving a child — we will report to the appropriate authorities.
You grant us permission to store and transmit what you type, so that we can
deliver it to the other player and keep the service working. We claim no
further ownership of it.
Chat is not private. It goes to the other player in your match, and it
passes through our server. Do not type anything into a game chat that you
would mind somebody else reading.
4. What you may not do
- Cheat, or use software that plays for you, or tamper with what the Game sends
the server
- Try to break, overload, or find your way into parts of the service that are
not yours
- Harass anyone, or use a name or chat message that is hateful, threatening, or
sexual about children
- Sell, buy, or transfer accounts
- Impersonate another player or us
We can suspend or close an account that does these things. If we close yours
and you had paid us recently, write to us; we will look at it fairly.
5. Supporter contributions
Supporting the Game is voluntary. It is a contribution to development, not the
purchase of a product, and it grants no gameplay advantage of any kind —
only cosmetic recognition (a crown and a coloured name).
- A monthly contribution renews automatically at the stated price until you
cancel. You may cancel at any time from the Support page or from the receipt
Stripe sends you. Cancelling stops the next charge; you keep supporter status
until the period you have paid for ends.
- A one-time contribution does not renew.
- Payments are processed by Stripe. We never see or store your card
details. Stripe's own terms apply to the payment itself.
Refunds. Because a contribution is voluntary, we do not owe refunds. In
practice we will refund a charge that was accidental, duplicated, or made by a
child without the card-holder's permission — write to erikdanielperez@nexuscoregaming.com.
Cancellation rights. If you are in the UK or EU you normally have 14 days to
change your mind about digital content. Cosmetic supporter status is made
available immediately, and at checkout you agree to that and to losing the
14-day right as a result. Your other statutory rights are unaffected.
6. Virtual items and currency
Any in-game currency, cosmetic, skin or other virtual item is a **limited,
personal, revocable licence to use it inside the Game**. It is not your
property, has no cash value, cannot be exchanged for money, and cannot be sold
or transferred to another person. Currency does not expire while your account is
active.
We may change, retire or rebalance cosmetic items as the Game changes. We will
not take away something you paid for out of spite, and if a paid item is
retired we will say so here.
7. Age
You must be at least 13 to hold an account, and 18 or over — or have the
permission of the person whose card it is — to pay us anything. The Game is not
directed at children under 13. If we learn we hold an account belonging to a
child under 13, we will delete it.
8. The Game will change, and may stop
This is an alpha made by one person. Features will change, balance will change,
and records may be reset while the Game is in alpha. We may stop running it. If
we do, we will give reasonable notice on this site.
9. Our stuff and your stuff
The Game, its art, sound, code, characters and world are ours or licensed to us.
Anything you make *about* the Game — art, videos, guides, strategies — is yours.
If you send us a suggestion, we may use it without owing you anything.
10. No warranty
The Game is provided "as is". To the fullest extent the law allows, we make
no warranties, express or implied, including of merchantability, fitness for a
particular purpose, or non-infringement. We do not promise the Game will be
uninterrupted, error-free, or that any record or item will be preserved.
11. Limit of liability
To the fullest extent the law allows, Erik Perez is not liable for indirect,
incidental, special, consequential or punitive damages, or for lost profits,
data or goodwill, arising from your use of the Game.
Where liability cannot be excluded, our total liability to you is limited to the
greater of the amount you paid us in the twelve months before the claim, or
twenty US dollars.
Nothing here limits liability for death or personal injury caused by
negligence, for fraud, or for anything else that cannot lawfully be limited —
and consumers keep every right their local law gives them.
12. Copyright complaints
If you believe something in the Game infringes your copyright, write to
erikdanielperez@nexuscoregaming.com with: what work you say is infringed, where in the Game it
is, your contact details, a statement that you believe in good faith the use is
not authorised, a statement that the information is accurate and that you are
the owner or authorised to act for them, and your signature (electronic is
fine). We will remove or disable anything properly identified, and we will tell
whoever posted it, who may send a counter-notice.
Repeat infringers have their accounts closed.
13. Law and disputes
Talk to us first. Before starting anything formal, write to
erikdanielperez@nexuscoregaming.com and give us 30 days. Most things are a misunderstanding and
take ten minutes to fix. This step is required of both of us.
Governing law. These terms are governed by the laws of New York,
without regard to its conflict-of-law rules.
Where. You and we agree to bring any dispute in the state or federal courts
located in New York, and each of us consents to those courts. This does
not apply where the law of your home country gives you the right to sue where
you live, or to be sued only there — consumers in the UK, EU, and elsewhere with
similar protections keep that right in full.
Small claims. Either of us may bring a matter in small claims court instead,
where it qualifies.
No class actions. To the extent the law allows, disputes are brought
individually, not as a class or representative action. Where that limitation is
unenforceable, it does not apply to you.
Nothing in this section takes away a right you have under the mandatory
consumer law of the place you live.
14. Changes
We may update these terms. The date at the top says when they last changed, and
material changes will be announced in the Game before they take effect. If you
keep playing after a change, you accept the new terms; if you do not accept
them, stop playing and, if you subscribe, cancel — and if a change materially
harms a subscription you have already paid for, write to us and we will refund
the unused part.
15. The rest
Severability. If any part of these terms is found unenforceable, the rest
stays in force and that part is applied as narrowly as the law allows.
No waiver. If we do not enforce something straight away, we have not given
up the right to enforce it later.
Whole agreement. These terms and the Privacy Policy are the whole agreement
between you and us about the Game.
Assignment. You may not transfer your rights under these terms. We may
transfer ours to a successor of the business, and will say so here if we do.
Force majeure. We are not liable for failures caused by things outside our
reasonable control, including a hosting provider, a payment processor, or a
network we do not run.
